General Terms and Conditions of Sale (GTC)

Article 1 – Purpose
These General Terms and Conditions of Sale (hereinafter referred to as "GTC") govern the sale of products made on the website Sevenvibesshop.com, operated by Seven Vibes (hereinafter "the Seller"), to any customer (hereinafter "the Customer").

Article 3 – Scope
These GTC apply to all orders placed via the website Sevenvibesshop.com.
All orders imply the Customer's unreserved acceptance of these Terms and Conditions.
Article 4 – Products
The Seller offers physical products for sale, which can be customized according to the Customer's specifications.
The essential characteristics of the products are described on the website. Photographs are not contractually binding.
Article 5 – Prices
Prices are indicated in euros (€), inclusive of all taxes (VAT), excluding delivery charges.
The Seller reserves the right to modify its prices at any time. The price applied is the one in effect at the time the order is validated. THE PRODUCTS REMAIN THE PROPERTY OF THE SELLER UNTIL FULL PAYMENT OF THE PRICE.
Article 6 – Orders
The Customer places orders directly on the website. All orders are firm and final after payment validation.
The Seller reserves the right to refuse or cancel any order in the event of an existing dispute with the Customer. Order confirmation implies acceptance of these terms and conditions of sale, acknowledgment of having read and understood them fully, and waiver of any right to invoke one's own terms of purchase or any other conditions. All data provided, along with the recorded confirmation, will serve as proof of the transaction. The seller will send an email confirming the order, which will constitute acceptance of the order.
Article 7 – Payment
This is a binding order, meaning that placing the order implies payment by the buyer.
To pay for their order, the buyer may choose from all payment methods made available by the seller and listed on the seller's website. The buyer guarantees to the seller that they have all necessary authorizations to use the payment method chosen when validating the order form. The seller reserves the right to suspend order processing and delivery in the event of a payment authorization refusal by officially accredited organizations or in the event of non-payment. The seller specifically reserves the right to refuse to make a delivery or fulfill an order from a buyer who has not fully or partially paid for a previous order or with whom a payment dispute is pending.

Payments are secure, and bank details are never stored by the seller.
Article 8 – Delivery
Products are delivered to the address provided by the customer when placing the order.
Deliveries are made worldwide.
Delivery times are indicative and may vary depending on the destination:
Local or national delivery: 1 to 5 business days;
International delivery: up to 15 business days.
The Seller shall not be held liable for delays attributable to the carrier, customs, or exceptional circumstances.
Article 9 – Right of Withdrawal
In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to personalized products.
Personalized products are therefore neither returnable nor refundable, except in the case of non-conformity or hidden defects.
Article 10 – Returns and Refunds
Non-professional buyers have a withdrawal period of fourteen days from the delivery of their order to return the product to the seller for exchange or refund without penalty (return shipping costs are the responsibility of the Customer). Returns must be made in their complete original condition (original packaging, accessories, instructions, etc.) allowing for resale as new, and must be accompanied by a copy of the purchase invoice. This right does not apply to products personalized upon request.
The seller undertakes to reimburse the buyer within 14 days of receiving the returned products (if all the aforementioned conditions are met). Refunds will be issued using the same payment method.
Article 11 – Legal Guarantees
The products are covered by the legal guarantee of conformity (Articles L217-3 et seq. of the French Consumer Code) and the guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code).
Article 12 – Liability
In the online sales process, the seller is only bound by an obligation of means. The seller cannot be held liable for any damage resulting from the use of the internet, such as data loss, intrusion, viruses, service interruptions, or other unintentional problems, as well as any event considered force majeure. The photographs accompanying the products are for illustrative purposes only and cannot guarantee a perfect likeness, particularly with regard to colors. If you have any doubts or require further information, please contact the seller.
Article 13 – Personal Data
Personal information is necessary for order processing and customer relations. In accordance with the French Data Protection Act of 6 January 1978, personal information relating to buyers may be processed automatically. Users have the right to access and rectify their personal data, in accordance with the law of 6 January 1978.
Article 14 – Intellectual Property
All elements of the website are protected by intellectual property law.
Article 15 – Taxes, Customs, and Imports
For international deliveries, customs duties, local taxes, import fees, or VAT may be levied by the destination country.
These charges are entirely the responsibility of the Customer. Refusal to pay these charges will not give rise to any refund.
Article 16 – Applicable Law and Disputes
These Terms and Conditions are governed by French law.
In the event of a dispute, an amicable solution will be sought before any legal action is taken.
Article 17 – Intellectual Property
All elements on the various online marketplaces (Website, Vinted, and Instagram) are and remain the exclusive intellectual property of the seller. Any reproduction, in whole or in part, of any element appearing on this site is prohibited.
